Domestics:
Info you should request from dispatch:
-Physical or Verbal
-Prior Calls to Location
-Drugs or Alchol Involved
-Weapons Involved
- Number of people involved
-Order for protection, restraining orders on location.
Approach to the scene:
-Park squad one house away
-Listen at door before knocking
-Stand in safe area (i.e not in front of a window.)
Contact:
-Announce present
-Seperate the parties and keep an eye on your partner (Face parties away from each other to avoid further problems.)
-Use calm communication
-Secure potential weapons
-Turn off disturbences (TV, radio, etc.)
-Find out what is going on
-Ask open ended question and follow-ups if needed
-Listen and watch for non- verbal clues
-Run warrant checks and OFPs on everyone involved.
Elements:
-Relationship? is it a domestic by law?
-Was there a crime commited
-Document Injuries (Photograph)
Arrest/ Control
-Good control of supects (If possible 2 officers to every suspect)
-Conduct safe and proper search
-Miranderize arrested/ detained suspects
Is it a domestic or regular assualt?
Phoxiland County Law (609.224) defines an assualt as a
(1) an act with intent to cause fear in another of immediate bodily harm or death; or
(2) intentionally inflicts or attempts to inflict bodily harm upon another.
What makes it a domestic?
-Married
-Relation by blood (Brother, sister, parent,etc.)
-Living together now or in the past
-Child in common
-Boyfriend/ Girlfriend (Significant Sexual/ Romantic relationship)
-Man and pregnant woman if he is the alleged father
If there is a domestic assualt, someone must placed under arrest, the victim cannot say they dont want to press charges for their saftey.
If suspect A punches Supsect B, and Suspect B punches back, they both will be placed under arrest unless Suspect B was in defense.
NOTE: An arrest can only be made within 24 hours after an assualt unless it leads to a greater crime. (Attempted homicide, etc.)
If someone is injured, you MUST ask if they want an ambulance. If wanted, have the ambulance standby in the area until the scene is 100% secure, then an officer must follow them down to the hospital for follow up or transport back to jail.
